DNREC issues cease and desist order

DNREC Secretary Collin O’Mara has issued a cease and desist order to International Petroleum Corporation of Delaware, Inc. for violations of Delaware’s laws and regulations governing hazardous waste management and of the company’s permit issued by DNREC’s Division of Air Quality. International Petroleum Corp. (IPC) operates a used oil recycling facility in Wilmington.

IPC is required to perform several analyses in an onsite laboratory to ensure that the used oil accepted at the facility is suitable for treatment. IPC generates waste as part of this quality assurance testing and also disposes of the waste generated in the laboratory in its used oil recycling process. However, the laboratory waste does not meet the acceptance and treatment criteria set forth in the Wilmington facility’s permit issued by the Division of Air Quality.

IPC also operates a program in which parts washer solvent is distributed to customers throughout the region. When the parts washer solvent can no longer be used by its customers, IPC picks up the used solvent and transports it back to its Wilmington facility. The used parts washer solvent is subject to Delaware’s regulations governing hazardous waste and is characterized as hazardous waste, and IPC does not have a permit to store the waste.
Based on assessments made this year on April 4 and 8, and August 22, a cease and desist order from DNREC has been issued to IPC to immediately cease the operations described above.
